Child Custody

The Will Nelson Law FirmFlorida judges do not actually use the term “custody” when making decision about children.  Whether the case stems from a divorce, or involves an action establishing the paternity of a child, the Court must determine how parents will make decisions regarding a child and also must decide how much time each parent will spend with the child.  These ideas are referred to as “parental responsibility” and “time-sharing”, respectively. 

The Court may consider many types of evidence when making decisions regarding parental responsibility and time-sharing, but will ultimately be guided by the best interests of the child or children.  The courts want parents to be responsible and to communicate effectively so as to promote the best interest of the children and to create the strongest relationship between the parents and the children they can be achieved under the circumstances.
